  • Essay / Retaliation Against NYPD Whistleblowers – Detective Called a Rat

    In 2005, first-year NYPD Detective James E. Griffith called internal affairs to report that he was being pressured by the from a fellow officer to lie and take responsibility during an internal investigation for his unit's mishandling of a homicide investigation (Goldstein, 2012). Another detective and union official claimed in his deposition that Griffin was a rat because he handled internal affairs instead of the union (Marzulli, 2013). According to the memorandum decision of the United States District Court for the Eastern District of New York, the retaliation was immediate, included negative actions against personnel, and continued throughout his career in different units until that Detective Griffith was effectively forced to retire due to harassment in 2009 (James Griffin v. City of New York, nd). Griffin ultimately filed a lawsuit against the City of New York, the NYPD and two of the officers involved individually. This case study will analyze the incident, the whistleblower laws, and the ethical challenges involved. Although Griffin does not reveal information that endangers public health or safety, he does disclose illegal and ineffective activities within his own organization. Bowman states that the ideal case for a whistleblower to reveal such information would be when the cause is just and all administrative remedies have been exhausted (Bowman, 1980). In my opinion, the cause is that - like the other detective, who asked Griffith to lie about the incident, he not only crossed ethical but also legal boundaries. However, since there is no mention of Griffith reporting the incident to his superiors before reporting it to Internal Affairs, I do not believe that Detective Griffith exhausted all administrative options available to him .
