Stop and search is a procedure implemented by the New York Police Department that aims to stop crime before it happens. Police arrest thousands of pedestrians every year. If a law enforcement officer finds a suspicious pedestrian, he or she may stop the pedestrian and conduct a stop and search. The procedure consists of feeling the outer clothing while questioning the pedestrian. When the police search a pedestrian, they are looking for weapons that could put them in danger, not drugs. A search is not an arrest; this is a temporary infringement of the freedom of pedestrians. An arrest involves the transportation and booking of a person. If a weapon is accidentally found or contraband, the search may lead to an arrest, but if the pedestrian suggests no danger, he or she should be free to leave. No stop or search may be made without probable cause; the Fourth Amendment to the United States Constitution protects against unreasonable searches and seizures; protects civilians against unreasonable searches of their person, home, papers and belongings. The framers of our Constitution did not believe that the government should have the power to violate the dignity or privacy of anyone. This was the perception of American freedom. More than a century ago, the Supreme Court concluded that "no right is more sacred or more carefully protected by law than the right of each individual to the possession and control of his own person, free from all restriction or interference.” , except under clear and indisputable legal authority. The Supreme Court concluded that no law enforcement officer may conduct a stop and search unless he or she has probable cause to believe that the individual has committed a crime or is about to to commit a crime.
