  • Essay / Separation of Powers - 565

If one person ran everything in the United States, there would be so much chaos in this world. Charles-Louis de Secondat, publishes Spirit of Laws which promotes the Declaration of the Rights of Man and the Constitution of the United States. He emphasized that to effectively promote freedom, the three powers must be separated and act independently (Separation of Powers, n.d.). To ensure that government power is not misused, the Constitution formed the separation of powers where each branch is assigned certain powers while being able to check and balance the other branches. It is divided into three branches, the legislative, executive and judicial branches. This created the system of checks and balances. Within each of the branches are made up of members; Legislative power rests with Congress, executive power rests with the President, and judicial power rests with the Supreme Court. Each branch has its own tasks which follow one another. One branch can do one thing, while the other can ignore it. The legislative branch is made up of the United States Congress, which has both a Senate and a House of Representatives. They can write and pass laws and taxes. They can declare war and establish budgets to be raised, financed and maintained during this period. Congress also has the authority to prescribe the laws and regulations in the Uniform Code of Military Justice under which the armed forces operate. Before generals and admirals take office, they are nominated by the president and confirmed by a majority vote of the Senate. The legislative power can open investigations against the executive power. The House of Representatives can impeach, while senators can remove executive and judicial officers...... middle of paper ...... provisions of the United States Constitution cannot be impeached implemented without sufficient consideration.
